TERMS & CONDITIONS — SOARING REALTORS

Effective date: October 24, 2025

These Terms and Conditions (“Terms”) set out the rules for the use of https://soaringrealtors.com (the “Site”) and for the provision of services by Soaring Realtors (“we”, “us”, “our”). By accessing or using the Site, contacting us, or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use the Site or request services.

2. Scope

These Terms apply to:

  • Visitors to and users of the Site.

  • Clients who instruct us for real estate consultancy, property management, interior services or shortlet management.

  • Any transactions, bookings, or communications made through the Site or through our staff.

Separate written agreements (engagement letters, management agreements, investment agreements) may supplement these Terms for specific services; where there is any conflict, the written agreement controls.

3. Services

We provide services including, but not limited to:

  • Real estate consultancy and advisory.

  • Property management and tenancy services.

  • Interior decor and staging.

  • Premium shortlet rental management.

All services are delivered subject to availability, applicable fees, and these Terms.

4. Booking, proposals and confirmation

  • Requests for services (enquiries, booking forms or calls) do not constitute a confirmed booking.

  • We will confirm bookings, allocations or accepted offers in writing (email or signed engagement). Only written confirmation by us creates a binding contract.

  • For investment opportunities, a reserve or allocation is held only when confirmed in writing and any required deposit is received.

5. Fees and payments

  • Fees for services, deposits and payment schedules will be set out in quotes, proposals or written agreements.

  • Payments are due on the dates specified in invoices or agreements. Late payments may attract interest, suspension of services or additional fees.

  • All fees are quoted in Nigerian Naira unless otherwise stated and are exclusive of taxes unless specified.

  • Refund and cancellation terms are set out in the specific service agreement; where no specific clause exists, refunds are handled at our discretion and in accordance with applicable law.

6. Client obligations

You agree to:

  • Provide accurate, up-to-date information needed to deliver services.

  • Respond to requests for documentation, access or approvals promptly.

  • Comply with applicable laws, building regulations and any rules agreed for property management or shortlet operations.

  • Keep passwords, account details and access credentials secure.

We are not responsible for delays or loss resulting from your failure to provide required information or approvals.

7. Property listings, accuracy and inspections

  • We strive to keep property listings accurate. However, information on the Site (images, descriptions, prices, availability) is provided for general guidance only.

  • You must inspect any property and rely on your own due diligence. We recommend professional surveys and legal checks before purchase or investment.

  • Prices, availability and specifications are subject to change without notice.

8. Investment opportunities — no financial advice

  • Information provided about investment opportunities is for general information only and does not constitute financial, tax or legal advice.

  • Past performance is not a guarantee of future returns. Investments involve risk, including potential loss of capital.

  • You should obtain independent professional advice before investing. We do not act as your financial adviser unless a separate, written advisory agreement is in place.

9. Intellectual property

  • All content on the Site (text, images, logos, designs, code) is our property or used under license.

  • You may view and print pages for personal, non-commercial use only.

  • You must not copy, reproduce, republish, modify, transmit, distribute or create derivative works from any content without our prior written permission.

10. User-generated content

  • If you submit reviews, testimonials, images or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and display that content in connection with the Site, marketing and services.

  • You confirm that you own or have the right to submit such content and that it does not infringe third-party rights. We may remove content that breaches these Terms or is unlawful.

11. Privacy and communications

Our use of personal data is described in our Privacy Policy available at https://soaringrealtors.com/privacy (or the published privacy page). By using the Site you accept the terms in the Privacy Policy and consent to being contacted by us by email, phone or messaging platforms (including WhatsApp) as necessary to provide services and respond to enquiries.

12. Third-party links and services

  • The Site may contain links to third-party sites or embed third-party tools. We do not control these sites and are not responsible for their content or practices.

  • Use of third-party payment processors, listing platforms or messaging services is subject to the third-party terms and privacy policies.

13. Limitation of liability

To the maximum extent permitted by law:

  • We, our officers, employees and agents are not liable for indirect, incidental, special or consequential losses, including lost profits, loss of business, or loss of data.

  • Our total aggregate liability for direct losses arising from our negligence, breach of these Terms or supply of services is limited to the fees you have paid to us for the relevant service in the 12 months preceding the claim.

  • Nothing in these Terms limits liability for death or personal injury caused by our negligence or for fraud.

14. Indemnity

You agree to indemnify and hold us harmless from any claims, liabilities, losses or expenses arising from your breach of these Terms, inaccurate information you provide, or your negligence.

15. Termination

  • We may suspend or terminate services and site access if you breach these Terms, fail to pay fees, or act unlawfully.

  • Either party may terminate a specific service agreement in line with the termination terms in that agreement. Termination does not affect accrued rights or obligations.

16. Force majeure

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, strikes, power outages, pandemics, government actions, or internet outages. Where practical we will notify affected clients and take reasonable steps to resume services.

17. Dispute resolution and governing law

  • These Terms are governed by the laws of the Federal Republic of Nigeria.

  • Parties should first attempt to resolve disputes in good faith by negotiation. If negotiation fails, disputes may be referred to mediation, and if unresolved, to the courts of competent jurisdiction in Nigeria.

18. Changes to these Terms

We may update these Terms at any time. The revised Terms will be published on the Site with an updated effective date. Continued use of the Site or our services after changes indicates acceptance of the new Terms.

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remainder of these Terms remain in full force and effect.

20. Entire agreement

These Terms and any written service agreements, together with the Privacy Policy, form the entire agreement between you and Soaring Realtors about the use of the Site and the provision of our services.
